2. What are the characteristics of Legal Translation

      Each language also has its own legal language. This legal language is found in the laws, judicial decisions and scientific opinions of countries. For this reason, legal translations differ from ordinary translations in some respects. 

     These features are as follows; 

  • It is necessary to use the words in legal terminology correctly in translations. For example, it would be incorrect to use the concept of cancellation of the contract for the word “termination”. Instead, the term “termination of the contract” should be used for the word “termination”. 
  • Legal translations usually contain long sentences. For this reason, the expressions in the sentence should be translated exactly. 
  • Legal translations should be done by legal experts or the translations should be checked by legal experts. 
  • When translating, the laws of the countries should be reviewed and the equivalent word in that law should be found instead of a literal translation. If the equivalent word in that country’s law cannot be found, the most accurate word must be preferred.

  • When translating a legal translation, the translator should have knowledge of the law of the target language. For example, the meaning of the concept of “izale-i şüyuu” should be known. It is not possible to translate without knowing the meaning of the legal concept.
  • The translator should be more careful especially when translating under oath. Because a sworn translation is a translation that is accepted by official institutions.

4. What are the types of Legal Translation?

         Legal documents are encountered in all areas of life. Legal documents are issued during official transactions. Therefore, there are many types of legal documents. In order for these legal documents to be valid in foreign countries or in our country, sworn translation is required. The types of legal translations in question are as follows; 

  1. Contract translation: A contract is an agreement regulating the mutual rights and obligations of private law legal entities. The translator must translate the contract in accordance with the terminology of the law of obligations and commercial law.
  2. Translation of Court Decisions: In order for foreign court judgments to be enforced in the country, the judgment must be translated with a sworn translation. In order for court decisions to be correctly understood in the target language, it is essential that the translation process is carried out by lawyers. 
  3. Power of attorney translation: A power of attorney is required by law for another person to carry out official transactions. In order for the power of attorney to be valid in another country, notarized translation and apostille procedures are mandatory. Since a power of attorney is a legal document, it should be translated by a translator with legal knowledge. 
  4. Translation of a letter of consent: In order for a child to travel abroad, his/her parents must give their consent. For this reason, it is necessary to translate the letter of consent for travel abroad. 
  5. Legislation translation:  Regulatory documents such as laws, bylaws, regulations, directives, etc. that are valid in the country. 
  6. Signature circular translation: Authorized signatories of companies must sign before a notary public in order to carry out legal transactions. In order for signature circulars to be valid abroad, translation of signature circulars is mandatory. 
  7. Trade registry gazette translation:  Changes in the articles of association, authorized signatories and addresses of companies must be published in the trade registry gazette. In order for the trade registry gazette to be valid abroad, a translation of the trade registry gazette is required. 
  8. Translation of company articles of association: The company’s articles of association is the contract in which the founders of the company regulate matters such as the company’s title, address, authorized signatories, management, and decision-making bodies. Companies need to have their articles of association translated in order to carry out transactions abroad.
